Welcome to Merzme’s AI Website Builder platform (https://app.merzme.com), a SaaS-based solution developed and owned by Merzme IT Solutions (https://merzme.com). These Terms and Conditions (“Terms”) govern your use of our AI Website Builder and related services.

1. Acceptance of Terms

By accessing or using our AI Website Builder, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our platform.

2. About Merzme

Merzme is a  IT Solutions company offering various services including:

  • Mobile App & Web Development

  • Software & E-commerce Solutions

  • Content Writing & SEO

  • Chatbot Development

  • Sales Automation

  • Graphics, Animation, and more

Our AI Website Builder is a proprietary SaaS product designed to simplify text to HTML website creation through AI-driven automation.

3. Use of the Platform

You agree to use the platform:

  • Only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations, including Indian and U.S. cyber and digital laws.

  • Only for creating websites related to legal and ethical businesses, personal portfolios, blogs, and organizational use.

  • Not for creating or promoting any content related to hate speech, adult content, scams, illegal drugs, terrorism, violence, or any other unlawful or unethical material.

Important:
We do not build or publish websites for users in our AI website builder platform(except active Pro or Elite plan users) . You must use the platform independently to generate your website. Final publishing on any domain is yours or your request-based responsibility.

4. Intellectual Property

All intellectual property rights related to the AI Website Builder, including its source code, design, algorithms, and branding, belong to Merzme. Users retain full ownership of the websites generated using the platform, including any custom content or designs uploaded by the user.

5. Hosting and Domains

  • We offer one free domain and hosting immediately upon purchase.

  • A second domain is included but must be claimed within 4 months from the purchase date. Failure to do so will void this claim, and you will need to purchase your second domain separately.

  • Domains provided are limited to a max value of ₹1299 ($16 USD). Any domain exceeding this will require additional payment.

6. No Guarantee of SEO

Our system includes basic Google indexing support for up to 5 websites. This is not a full SEO service. To activate this, contact: aisupport@merzme.com.

7. Access & Control

  • You will not be given super admin or cPanel-level access.

  • You may manage content using our AI Builder dashboard only.

  • To publish updates, you must use the AI editor and notify our team. We will update the server version accordingly.

8. Data Privacy & Security

We respect your privacy and comply with all global data protection regulations, including the General Data Protection Regulation (GDPR) and India’s IT Act, 2000. Please refer to our Privacy Policy for more details.

9. Subscription & Payment

  • Our plans are available as period-based access (3 months, 1 year, or 2 years).

  • No recurring subscriptions. You only pay once for the chosen access period.

  • You may renew your access by purchasing a new plan as needed.

10. Termination & Restrictions

Merzme reserves the right to:

  • Terminate or suspend your access for violating these Terms.

  • Refuse service to any project deemed harmful, misleading, illegal, or unethical at our sole discretion.

11. Limitation of Liability

Merzme is not liable for:

  • Any damages resulting from use or inability to use the AI Website Builder.

  • Content created and published by users.

  • Loss of data or hosting issues not directly controlled by Merzme.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of:

  • India, where Merzme is headquartered.

  • USA, for users based in the United States.

  • Other international laws applicable in the user’s jurisdiction.

14. Feedback & Improvements

Any feedback, suggestions, or ideas submitted to Merzme regarding the AI Website Builder or any other services may be used to improve the platform. You agree that Merzme may implement such feedback without any obligation to compensate you.

15. Third-Party Integrations

The AI Website Builder may integrate or interact with third-party tools or APIs (e.g., Google Fonts, analytics, Google APIs, ChatGPT APIs, ads providers, aiboostx.com, any white-label providers, domain providers and generators,  or payment processors Etc…). Merzme is not responsible for any issues, outages, or data handling by such third parties.

16. Content Responsibility

Users are solely responsible for the legality and accuracy of the content they input or generate using the builder. Merzme does not review, approve, or endorse any user-generated content.

17. Maintenance & Downtime

While we strive for 99.9% uptime, occasional maintenance or technical issues may cause brief outages. Merzme is not liable for any loss of business or revenue during such periods.

18. Age Requirement

You must be at least 18 years old to use the AI Website Builder. By using the platform, you confirm that you meet this age requirement.

19. Compliance with Export Laws

Users agree not to use the platform in violation of any export laws, sanctions, or trade restrictions, particularly those enforced by India, the USA, or international governing bodies.

20. Force Majeure

Merzme is not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, war, terrorism, labor actions, internet outages, or governmental restrictions.

21. Intellectual Property Ownership

All underlying code, algorithms, UI/UX, features, and documentation of the AI Website Builder and Merzme services are the intellectual property of Merzme IT Solutions. Users receive a non-exclusive, non-transferable license to use the platform as per their plan, but no ownership rights are transferred.

22. Fair Usage Policy

To prevent abuse or misuse of resources (e.g., mass website generation, excessive downloads), Merzme may implement a fair usage policy. Excessive usage may result in a temporary suspension or request to upgrade the plan.

23. AI Limitations Disclosure

You understand that our AI may not always produce error-free, industry-compliant, or perfect websites. It’s your responsibility to review and validate the final output before use. Merzme is not responsible for errors or omissions in AI-generated content.

24. Template & Design Licensing

All website templates and design layouts provided through the builder are licensed for personal and business use. You may not resell or redistribute them as standalone digital assets.

25. Reselling Restriction

Unless expressly permitted in writing, users may not resell, sublicense, or white-label our AI builder or its generated outputs for use by third parties.

26. Governing Law & Jurisdiction (Extended Clause)

This Agreement shall be governed by the laws of India and the United States, with primary jurisdiction in Pune, Maharashtra, India. International users agree to resolve disputes through arbitration or legal processes under Indian IT and SaaS law frameworks.

27. Email & Communication Consent

By using our services, you agree to receive service-related emails, promotional offers, and essential system notifications from Merzme or its team. You can unsubscribe from non-essential messages.

28. Refund Policy

Due to the nature of digital and downloadable assets, we do not offer refunds once access is granted or products are downloaded (except in some cases for Elite active plan holders). Please review all demo materials and features before purchasing

Model 29 – Beta Features Disclaimer

Some features of our AI Website Builder may be released in beta. Beta features are provided “as-is” for testing and feedback. They may contain bugs, undergo changes, or be removed at any time. Use of beta features is entirely at your own risk.

Model 30 – Service Modification & Discontinuation

Merzme reserves the right to modify, suspend, or discontinue any part of the AI Website Builder at any time, with or without notice, for reasons such as maintenance, legal compliance, or system upgrades. We are not liable for any loss due to service interruption.

Model 31 – Automated Content & Legal Liability

Our AI may generate content like text, layout suggestions, or marketing phrases. You are solely responsible for ensuring the final website complies with local laws, industry regulations, and trademark/copyright rules. Merzme assumes no liability for AI-generated content used publicly.

Model 32 – Data & Backup Responsibility

While we strive for reliability, Merzme does not guarantee automatic backups of user-generated websites or content. Users are responsible for downloading and securely storing their websites upon generation.

Model 33 – Security & Access

Users agree to maintain the confidentiality of their login credentials and are responsible for all activities under their account. Merzme will never ask for your password and encourages use of strong authentication.

Model 34 – Compliance with Global Sanctions & Export Laws

You may not use Merzme’s services if you are located in a country under embargo by the Indian government, the United States, or United Nations sanctions. By using the platform, you represent that you are not on any restricted party list.

Model 35 – General Disclaimer of Liability

Merzme and its AI Website Builder platform are provided “as-is” and “as-available.” We make no guarantees of specific outcomes related to business growth, income generation, user engagement, or success in any field. Use of the service is entirely at your own discretion and risk.

Model 36 – No Professional Advice

The AI-generated website content, copy, or design is not a substitute for professional, legal, medical, financial, or business advice. Users should consult qualified professionals before making decisions based on content generated through our platform.

Model 37 – No Guarantee of Results

Merzme does not guarantee that the use of its AI Website Builder will result in increased traffic, sales, visibility, health, or relationship outcomes. Success depends on numerous external factors beyond our control, including user input, market trends, and competition.

Model 38 – Limitation of Liability

To the fullest extent permitted by applicable law, Merzme and its team are not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to:

  • Business loss

  • Financial loss

  • Relationship loss

  • Emotional distress

  • Health issues

  • Reputational damage

  • Data loss or corruption

This applies even if we have been advised of the possibility of such damages.

Model 39 – User-Induced Errors

Users are fully responsible for any errors, bugs, or losses resulting from incorrect inputs, misunderstanding AI suggestions, misuse of downloaded files, or failure to follow setup instructions.

Model 40 – Indemnification Clause

By using the AI Website Builder, you agree to indemnify, defend, and hold harmless Merzme, its founders, partners, developers, and affiliates against any claims, liabilities, damages, legal costs, or expenses arising out of:

  • Misuse of our platform

  • Violation of laws or third-party rights

  • Generated content that violates copyright, trademark, or defamation laws

  • Any harm resulting from the use of AI-generated websites

Model 41 – Force Majeure

Merzme will not be liable for delays or failures in service due to events beyond our control, including but not limited to natural disasters, cyberattacks, power outages, strikes, server failures, regulatory changes, or pandemics.

Model 42 – Platform Ownership and Compliance

All technology and intellectual property related to the AI Website Builder SaaS remain the sole property of Merzme. Any attempt to reverse-engineer, duplicate, or resell our platform without permission is prohibited and may result in legal action.

43. Force Majeure

Merzme and its associated platforms (including the AI Website Builder and manual services such as chatbot development, app development, blockchain/NFT services, etc.) shall not be held liable for any failure or delay in performance due to circumstances beyond reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, internet outages, server failures, hosting interruptions, technical issues, cyberattacks, pandemics, government restrictions, or labor strikes. In such events, services may be delayed, suspended, or modified without liability.

44. Changes to Policies

Merzme reserves the right to modify, update, or revise these policies (including Terms & Conditions, Privacy Policy, Disclaimer, and Refund & Cancellation Policy Etc..) at any time, without prior notice. Changes will be posted on the official website (https://merzme.com) or relevant subdomains. It is the user’s responsibility to review the policies periodically. Continued use of the platform after any changes constitutes acceptance of the updated terms.

By accessing, using, purchasing, subscribing to, or interacting with any part of Merzme’s platforms — including but not limited to the AI Website Builder, chatbot services (AI or human-integrated), website/app/blockchain/NFT development, and any related tools, services, or digital assets — you confirm that you have read, understood, and agreed to all of our published policies, including our:

If you do not agree to any part of these terms, you must not use or access our services in any manner.
